As long as you’re making your car payments and can continue to do so, you’ll typically keep your vehicle during and after bankruptcy. Just like outside of bankruptcy, if you stop making payments, the lender can repossess the car — but bankruptcy provides an important protection called the automatic stay.


This temporarily prevents creditors from repossessing your car while your case is active, giving you breathing room to catch up or reorganize your payments.


Texas also has very generous exemption laws, which allow every licensed driver in your household to protect one vehicle. That means it’s rare for someone in Texas to lose a car through bankruptcy, even if they own more than one vehicle.
